GDPR: Principles of processing personal data of natural persons in ELVAC a.s. for the purpose of providing services of the “smelvee” system

1. Introduction

If you become a registered user of the services associated with the small e-mobility infrastructure system “smelvee“, it is necessary to provide us with your personal data to the extent necessary for the provision of the services and the contractual relationship. In addition, you can choose to fill in some optional personal data yourself to make your use of the services more convenient. We are fully aware of our responsibility for their protection and security. At the same time, we want to assure you that we take the protection of personal data with full seriousness and utmost effort. These are the basic principles of such protection, as well as your rights in relation to the GDPR (General Data Protection Regulation).

2. Personal data controller

Our company ELVAC a.s. with registered office at Hasičská 53, 700 30 Ostrava, Czech Republic processes your personal data as a controller, i.e. we determine how, for what purpose and for how long the personal data will be processed.

We declare that, as the controller of your personal data, we comply with all legal obligations required by applicable legislation, in particular the Personal Data Protection Act and the GDPR. In particular:

  • we comply with the information obligation before the processing of personal data pursuant to Article 13 GDPR,
  • we process your personal data only on the basis of a valid legal ground (in particular, a legitimate interest, performance of a contract, a legal obligation or your consent),
  • we provide you with full cooperation and support in exercising your rights under the Data Protection Act and GDPR,
  • We use all the technologies available to us to protect your personal data. We have adopted, maintain and continually improve the measures available to prevent the misuse, damage or destruction of your personal information.

3. Categories and purposes of processing of personal data

What personal data do we process, for what purpose and for how long?

We process the personal data you entrust to us for the following reasons:

Sale of goods, provision of services and performance of the contract
Your personal data in the range of name, surname, date of birth, residence, contact e-mail and telephone number are necessary for the conclusion and performance of the contract (provision of services). Additional personal data such as height and body weight can be entered into the system at your own discretion to improve the services provided – if you do so, the system will be able to better estimate the expected range of e-cars, etc., otherwise it will use predefined default data for the established functionalities.

Accounting
If you are our customer, we need your personal data (invoicing data) because we are legally obliged to issue, record and archive tax documents.

Marketing – providing information
We use your personal data (e-mail, name), which you click on in e-mail messages, for the purpose of direct marketing and informing you about new products in our range. We do this out of legitimate interest, as we assume that you are interested in this news. If you are not our customer, we send you marketing information based on your prior consent. You can stop receiving marketing emails at any time by using the unsubscribe link in such emails or also directly on the website by logging in to your user profile.

Cookies
When you visit our website, we record your IP address, how much time you spend on the site, or which page you come from. We see the use of cookies to measure traffic to our website and to personalise the display of the website as a legitimate interest of our administrator, as we believe that this enables us to offer you a better service. You can disable the use of cookies in your internet browser on your computer. You can find the procedure in the instructions for the respective internet browser.

4. Disclosure of personal data to third parties

Your personal data can be accessed by our employees and associates who are bound by confidentiality and trained in data protection. Trust that we can do most of the processing ourselves. However, for some specific processing operations that we cannot provide on our own, we use third-party services and applications that specialize in that processing and comply with the GDPR.

They are the providers of these services and platforms:

  • Smartemailing- sending marketing newsletters
  • Google Analytics (anonymous statistics on traffic and usage of our website, Google Adwords
  • Freight forwarding companies for delivery of goods (Geis, PPL, DHL, DPD, EMS, FedEx, GLS, INTIME, Slovak Post, Czech Post, TNT, UPS)

We may decide to use other third party services and applications in the future. However, we will certainly place at least the same demands on them in terms of GDPR security and quality of processing as on ourselves.

5. Provision of data outside the EU

We only process personal data in the European Union or in countries that ensure an adequate level based on a decision of the European Commission.

What are your rights in relation to data protection?

You have broad rights in relation to data protection. If you wish to exercise any of your rights, you have:

  • Right to Information – which is fulfilled by this document.
  • Right of access – you can ask us to provide you with information about what personal data we hold about you and why. We will respond to you as soon as possible, but no later than 30 days.
  • Right to rectification – you can ask us to complete or change your data.
  • Right to erasure (to be forgotten) – on request, we will erase your personal data that we are not obliged to archive on the basis of other legal requirements (e.g. the Accounting Act, the Value Added Tax Act, etc.).
  • Right to restriction of processing – in case you do not want to delete all the data, but only want to limit the scope or purpose for which we process it, as well as the retention period.
  • Right to object to data processing – in some cases, we may process your personal data without your consent based on our so-called legitimate interest. You have the right to object to this.
  • Right to portability – you have the right to request from us all your personal data that we process about you.
  • Right to complain – if you feel that we are not handling your personal data in accordance with the law, you can complain either directly to us or to the relevant data protection supervisory authority.

6. Silence

We want to assure you that our employees and associates who process your personal data in any way are obliged to maintain confidentiality of personal data and security measures, the disclosure of which would compromise the security of your personal data. This confidentiality continues even after the end of the business or employment relationship with us.
